Position: Legal and Recovery Officer (2 Vacancies)
Purpose:
The Legal and Recovery Officer provides legal expertise and services to BRAC Tanzania, including:
- Developing and implementing strategies for proper legal recovery of overdue loans.
- Reviewing and preparing loan agreements and other corporate and legal documents.
- Assisting in interpretation and translation of country legislation.
- Handling litigation of civil, recovery, and labor cases.
Job Responsibilities:
- Develop and implement proper strategies for recovery of overdue loans.
- Follow up on recovery cases at Primary, District, High Court, and District Land and Housing Tribunal across the country and maintain a list of cases.
- Conduct legal research and provide advice on compliance with new legislation or best practices affecting microfinance operations.
- Review fraud investigation reports and recommend appropriate legal actions.
- Follow up on cases reported to police stations and hold watching briefs in criminal proceedings, reporting progress accordingly.
- Submit monthly reports on new and existing legal suits, progress of credit recovery cases, trend analysis, and recommendations.
- Regularly review and perfect documentation for credit facilities in line with microfinance policy and relevant legislation.
- Review and prepare contracts and other corporate and legal documents.
- Train staff on legal issues arising from BRAC Tanzania operations, including identification of genuine securities.
- Coordinate and oversee legal compliance activities across field offices, and represent BRAC Tanzania in legal litigations within delegated authority.
- Participate in reviews and amendments of BRAC policies and procedures.
- Prepare progress and annual legal affairs reports.
Safeguarding Responsibilities:
- Ensure the safety of team members from harm, abuse, neglect, harassment, and exploitation.
- Act as a key source of support, guidance, and expertise on safeguarding to establish a safe working environment.
- Promote and implement safeguarding policies and standards in all operations.
- Follow safeguarding reporting procedures for any reportable incidents and encourage others to do the same.
Required Qualifications and Experience:
- Bachelor’s degree in Law (LL.B) and Post Graduate Diploma in Legal Practice.
- Must be a Registered Advocate.
- Minimum 2 years’ experience in legal practice, particularly litigation.
- Excellent knowledge of recovery cases and all legal matters related to microfinance and financial institutions.
- Demonstrated knowledge of labor law matters.
- Planning skills with the ability to work accurately and meet deadlines.
- Mature judgment and discretion in handling sensitive legal and administrative issues.
- Management of workplace diversity.
- Excellent communication and presentation skills in English (written and verbal).
- Ability to work under pressure.
- Strong problem-solving skills.
- Strong analytical skills and ability to conduct comprehensive legal research, including complex or unique issues.
- Ability to influence others and reach agreement.
- Computer literacy with effective use of MS Word, Excel, and PowerPoint.
